MagBacker LLC Warrants

To the direct purchaser that at the time of sale the MagBacker Panel products (here in after as “product”) for interior applications in the United States of America:

• Will be free of defects in material and workmanship which makes them suitable for their intended use.
• Will not delaminate.
• Will not deteriorate as a result of normal exposure to moisture in areas where the product is approved for use.

Warranty Term The warranty term will remain in effect for thirty (30) years from the date the product is purchased from MagBacker LLC.

Warranty Conditions Warranty coverage under this limited warranty shall be subject
to the following terms and conditions:

• A covered person must provide written notice to MagBacker LLC within 30 days after discovery of any claimed defect covered by the limited warranty. In addition, no permanent repair can take place until MagBacker LLC has reviewed/inspected
  and authorized such permanent repair.
• The letter must include the following:
• Proof of purchase from distributor or retailer, including receipt,
  invoices and other documents which may show the dates of
  purchase and installation.
• The notice must describe the location and details of the claimed defect
  and any additional information needed for MagBacker LLC to
  investigate the claim.
  
  In addition:
• The product must be installed according to MagBacker LLC printed
  installation instructions and in compliance with all building codes
  adopted by federal, state, and local government agencies applicable to
  the installation.
• Upon discovery, the covered person at their own expense will provide
  protection for all property that could be affected until remedied, if applicable.
• The covered person must allow a MagBacker LLC authorized agent on
  site to inspect, take additional pictures and samples of the material in question.
• Prior to installation the product must have been properly handled and stored at
  all times and has not been abusd or used for any improper application.

What Is Not Covered in This Warranty
Exclusions/ Limitations:

• Further product processing and alteration after shipment from MagBacker
  LLC.
• Neglect, abuse and/or misuse.
• Installation over structural framing members which are twisted or bowed.
  Settling or structure movement of the building and/or movement of the
  products which MagBacker is attached to. Movement of bonding adhesive
  or mortars.
• Exceeding maximum floor deflection.
• Acts of God including but not limited to earthquakes, tornadoes, storms,
  hurricanes, fires, floods or other natural phenomena ( including but not
  limited to unusual climate conditions).
• Improper care or maintenance of the building.
  Any other cause than material or manufacturing defects attributed to
  Magbacker LLC.
• The incidental, indirect, or consequential damages or expenses. The customers
  exclusive remedy for any type of claim or action for defective products will
  be limited to the replacement of the product ( in the form originally shipped)
  at MagBacker LLC. Option to a payment or credit not greater than the original
  purchase price. Some states do allow this exclusion so such exclusion may
  not apply to you

The Total Agreement This limited warranty represents the only warranty extended by Magbacker LLC
for the product. No other party is authorized to make any other warranty in
addition to this limited warranty.
